This document is a legal agreement between you and Dr. Ivan Maric, FELIB ("IM"). By downloading or using this software or its documentation, you agree to be bound by the terms of this agreement.


"The software" means the IM software product for which you have paid a license fee to IM.

"The licensed computer" means the computer nominated by you at the time you paid a license fee to IM, or any computer to which IM has agreed to transfer the license.

Software License

IM grants you the right to use the executable programs on the licensed computers for the period of one year. If you have paid for a "Single user license" this right is limited to a single computer installation. If you have paid for a "Site license", this right is extended up to 20 computers located at the same site and inside the same enterprise. If you have paid for a "World-wide site license", this right is extended up to 100 computers world-wide and inside the same enterprise.

IM grants you the right to merge the purchased DLL classes into your executable products for sale. For each new product type you need to purchase a separate license. In the 'additional comments' box for the supplier, given at the Kagi E-Commerce page (URL: http://store.kagi.com/?ZQU_LIVE&lang=en), you need to specify the product title. You can sell your products with embedded licensed DLL class in unlimitted quantities. If you do not specify the product title you are allowed to embed the purchased DLL class into the executable programs for your personal use. When merging a DLL class into the distributed process measurement and control software a separate license must be purchased per each measurement site (up to 20 measurement points) that needs the calculation of the corresponding DLL procedure.

IM grants you the right to merge the purchased royalty free source code into your products for sale with no restrictions.

You may copy the software as required for backup and archival purposes.

You may not use, copy, modify, or transfer the software, or any copy, modification, or merged portion, in whole or in part, except as expressly permitted by this agreement. Any portion of the software merged into another program continues to be subject to the terms and conditions of this Agreement.

You may not reverse engineer, decompile, or disassemble the software, except and only to the extent that such activity is expressly permitted by applicable law.

You acknowledge that all rights in the software, including the rights to modify the software, remain with IM.

Disclaimer of Warranty

The software is provided "as is" without warranty of any kind. IM further disclaims all implied warranties including, without limitation, any implied warranties of merchantability or of fitness for a particular purpose. The entire risk arising out of the use of the software and documentation remains with you. In no event shall IM or anyone involved in the creation or documentation of the software be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, interruption of business activity, loss of business information, or other monetary loss) arising out of the use or inability to use the software or documentation. You agree not to obtain or use the software in any state or country that does not allow the exclusion or limitation of liability for consequential or incidental damages.

Applicable Law

This Agreement shall be governed by the Laws of the Republic of Croatia. You agree to submit to the jurisdiction of the Courts of Croatia.
